DIFFERENCE BETWEEN IJTIHAD AND TAQLID
1. Introduction:
Taqlid mesans passive acceptance and following the opinion of another person without questioning the quthority for such opinion. Taqlid begins where Ijtihad ends. The purpose of Taqlid is to discover and apply the law in the light of the already settled law.
2. Definition of Taqlid:
Taqlid is following the decision of a jurist without demanding arguments because of confidence in his learning.
3. Meaning of Ijtihad:
It means striving and expending maximum effort in the performance of an act.
4. Definition of Ijtihad:
Ijtihad means to strive hard to know the rules of Shariah.
6. Distinction between Ijtihad and Taqlid:
i. Meaning:
Ijtihad means to strive hard to know the rule of Shariah while Taqlid means following the opinion of a jurist in matters which have not been dealt with by express Quranic or the traditionary texts.
ii. Definition:
Ijtihad is striving maximum effort in the performance of an act while Taqlid is following the opinion of another person.
iii. Opinion:
In Ijtihad opinion is farmed while in Taqlid opinion of a person is followed.
iv. Qualification:
In Ijtihad a person must possess necessary qualificaion while in taqlid it is not necessary for a person to possess some qualificaion.
v. Scope:
The scop of Ijtihad is wider while Taqlid has less scope.
vi. Source of Islamic law:
Ijtihad is basec source of Islamic law while Taqlid is the secondary source of Islamic Jurisprudence.
