FEATURES OF BRITISH CONSTITUTION
1. INTRODUCTION:
The collection of principles according to which the powers of the Government the rights of the governed and the relation between two are adjusted.
2. Definition:
Accordng to Aristotle Costitution is the way of life the stat has choosen for itself.
3. Features of British Contitution:
(i) Partly Written AND Partly Unwritten:
The British Contitution is unwritten in its character e.g., Magna Carta 1215,
Reforms Act, etc. The British Contitution is based upon customs and conventions of British culture.
(ii) Evolutionary Growth:
The British Constitutiion is a child of wisdom and chance. It has grown like an organism from age to age it is the oldest amoung existing constitutions.
(iii) Difference Between the Theory and Practice:
One of the unique features of the British Constitution is the gap that exists between constitutional theory and government practices.
(iv) Parliamentary Sovereignty:
There is no law which the British Parliament cannot make ow unmake. No court can question the legality of its acts.
(v) A Unitary Constitution:
In England the government is unitary. All the power is concertrated in a single government centered in London.
(vi) A Flexible Constitution:
The British Parliament is empowered to pass and amend the ordinary law as well as the constitutional law through the same ordinary procedure.
(vii) The Rule of Law:
The rule of law means the supremacy of dominance of law, as distinguished from mere arbitrariness. But it soes not mean that the Englishmen enjoy no rights.
(viii) Conventions:
Prof. Smith says that conventions are main living source behind the Constitution. In the U.K. the government is formed and removed on convention basis.
(ix) Universal Adult Suffrage:
Every individual who has attained the age of 18 has the right ot vote.
(x) Two Party System:
In the U.K. there is two party system right from th ebeginning of parliamentary period. Before the emergence of Labour the Party, there wereConservative and Liberal Party. But today, there are Conservative and Labour Party in U.K.
